ARTICLE 2 - SUBJECT OF THE AGREEMENT

2.1. The subject of this agreement is to define the rights and obligations of the parties under Law No. 6502 on the Protection of Consumers, the Distance Contracts Regulation, and related legislation with respect to the sale and delivery of the product(s) ordered electronically via the Seller’s website denizciden.com (“Website”) by the natural or legal person (“Buyer”) signing this agreement. Provisions of the Code of Obligations and the Turkish Commercial Code shall apply to Buyers who are not consumers.

2.2. The Buyer acknowledges and declares that they have been clearly and comprehensibly informed, in an appropriate online format, of the Seller’s name, title, full address, phone number and other contact details; the main characteristics of the goods; the sales price inclusive of taxes; the payment method; the delivery terms and costs; the right of withdrawal and its exercise; and the complaint channels; that they have confirmed these details electronically; and have subsequently placed the order.

2.3. The Pre-Information on the Website and the invoice issued upon the Buyer’s order form integral parts of this agreement.

ARTICLE 4 - INFORMATION PROVIDED TO THE BUYER

  • The Seller’s name and contact information
  • The main characteristics of the product(s), total price including taxes, shipping costs
  • Delivery, invoice and payment details for the product(s)
  • Shipping restrictions imposed by the Seller
  • Conditions, duration and procedure for the right of withdrawal
  • Product(s) for which the right of withdrawal does not apply
  • Return procedures and financial matters (return methods, costs, refunded amount, reward point refunds)
  • Sales stages and tools for correcting information
  • Complaint and objection channels (Consumer Arbitration Committee, Consumer Court)

ARTICLE 5 - ORDER & PAYMENT TERMS

The total TRY amount including VAT of the products selected by the Buyer and any shipping costs shall be collected via the selected payment method upon the Buyer’s approval; shipment will not occur until the order confirmation email is sent to the Buyer.

ARTICLE 6 - SHIPPING AND DELIVERY TERMS

  1. 6.1. The Seller shall dispatch the Products via its contracted shipping company within a maximum of 30 days. If there is no branch in the Buyer’s location, the Buyer is obliged to collect the product from the nearest branch within 7 days; otherwise, any loss and expenses shall be borne by the Buyer.
  2. 6.2. If neither the Buyer nor the person designated by the Buyer is present at delivery, the Seller shall be deemed to have fulfilled its obligation; any delay or return costs shall be borne by the Buyer.
  3. 6.3. The Buyer is obliged to inspect the product upon delivery and to document any damage with the delivery agent.
  4. 6.4. In case of force majeure, the Seller shall immediately inform the Buyer; the Buyer may exercise the right to cancel or postpone. If the product cannot be supplied, the Seller shall notify the Buyer within 3 days, and if the Buyer cancels, the Seller shall refund within 14 days.
  5. 6.5. In case of credit card fraud, the Buyer shall return the product within 3 days; shipping costs shall be borne by the Buyer. The Seller reserves all other rights.

ARTICLE 7 - BUYER’S RIGHT OF WITHDRAWAL AND CONDITIONS

7.1. The Buyer has the right to withdraw within 14 days from the date of receipt; this right remains valid from contract conclusion until delivery.

7.2. The right of withdrawal cannot be exercised for the following goods/services:

  • Goods/services whose price depends on financial market fluctuations
  • Custom-made or personalized goods
  • Perishable goods or goods past their expiration date
  • Goods whose packaging has been opened and are not suitable for return for hygiene reasons
  • Goods that cannot be separated due to their nature
  • Services fully performed with the Buyer’s prior consent before the withdrawal period expires

7.3. Withdrawal notification:

  1. Before handing the product to the shipping company: [email protected] or 0535 575 94 80
  2. After courier delivery: return the product with the return form/invoice and original packaging and accessories to the shipping company

7.4. Returns shall be made within 10 days from the date of notice; shipping costs shall be covered by the Seller if the contracted company is used.

7.5. The Seller shall refund all payments within 14 days once conditions are met.

7.6. Rights shall be forfeited in cases not legally eligible for withdrawal or if the procedure is not followed correctly.

7.7. In partial returns, the right of withdrawal may be exercised after delivery.

7.8. Products sold in retail stores are not accepted for return.

ARTICLE 8 - PRIVACY, DATA SECURITY, PERSONAL DATA AND INTELLECTUAL PROPERTY

  1. 8.1. The Buyer is responsible for protecting data entered on their device.
  2. 8.2. The Buyer may request suspension, deletion or correction of processed data via the communication channels.
  3. 8.3. Site content and intellectual property rights belong to the Seller.
  4. 8.4. The Buyer may access the Pre-Information text by email; the Seller retains it for 3 years.
  5. 8.5. No data sharing without the Buyer’s consent; use by partners complies with data protection law.
  6. 8.6. The Buyer’s rights under data protection law are reserved.

ARTICLE 9 - FORCE MAJEURE

9.1. Events beyond control and unforeseeable shall constitute force majeure; the affected party shall notify the other in writing.

9.2. If force majeure continues for 30 days, either party shall have the right to unilaterally terminate.

ARTICLE 10 - DISPUTE RESOLUTION AND COMPETENT COURTS

In disputes, Consumer Arbitration Committees at provincial/district level within the limits determined by the Ministry of Customs and Trade shall have jurisdiction; for amounts exceeding those limits, Consumer Courts shall have jurisdiction.
